I. SERVICE PROVISION PROCESS AT VINASC:

 

Step 1. Vinasc receives information regarding the company’s application for a fire prevention and fighting design approval certificate, including the following basic details:

  • General information about the project/construction/vehicle: Project/construction/vehicle name; investor/vehicle owner name; legal representative; total investment;
  • Construction/manufacturing location;
  • Design consultant for the project/construction/vehicle;
  • Project/construction scale: height, number of floors, function; scale; load; number of people working; Vinasc will review the specific legal requirements involved to develop a service implementation plan.

Step 2. Depending on the specific case, Vinasc will consider providing advice and guidance related to the company’s application for a fire prevention and fighting design approval certificate. Both parties discuss to agree on the service content. Vinasc then drafts the contract and sends it to the customer for signing.

Step 3. Vinasc guides the customer in preparing the necessary documents for the application for a fire prevention and fighting design approval certificate, including:

  • List of personnel trained in FPF
  • Documents proving compliance with FPF safety conditions
  • Detailed planning drawing 1/2,000 (for industrial parks over 20 ha), scale 1/500 (for other cases) showing the required FPF solutions;
  • Design explanation document outlining the required FPF solutions;
  • Land use right certificate/Document proving legal land use right;

Step 7. Deliver to the company the specific results, listed in Section 2 below, that Vinasc collects on behalf of the company during the service provision process.

IV. SOME REGULATIONS RELATED TO THE ISSUANCE OF DESIGN APPROVAL CERTIFICATES FOR FIRE PREVENTION AND FIGHTING

  1. Fire Prevention and Fighting Safety Conditions for Facilities
  • Must have internal regulations, prohibition signs, warning signs, diagrams, or instructions regarding fire prevention, firefighting, and escape routes that comply with fire prevention and firefighting standards or regulations issued by the Ministry of Public Security.
  • Must have on-site fire prevention and firefighting forces specialized for the facility type, trained in fire prevention and firefighting procedures, and organized to be ready to respond to fires on-site as required, except in cases specified in point g, clause 3, Article 31 of Decree 136/2020/ND-CP.
  • Must have a fire fighting plan approved by the competent authority.
  • Electrical systems, lightning protection, antistatic systems, electrical equipment, fire-generating equipment, heat-generating equipment, and the use of fire and heat sources must ensure fire safety in accordance with fire prevention and firefighting standards or regulations issued by the Ministry of Public Security.
  • Must have traffic systems, water supply, communication systems for firefighting, fire prevention and firefighting database management systems, incident reporting systems, fire alarm systems, fire suppression systems, smoke control systems, escape systems, and other fire prevention and firefighting equipment, as well as rescue equipment that meet the quantity and quality requirements of fire prevention and firefighting standards or regulations issued by the Ministry of Public Security.
  • Must have a design approval certificate and design approval documents (if any), and a document approving the fire prevention and firefighting inspection results from the Fire Police agency for projects and constructions listed in Appendix V issued with this Decree, except for national defense facilities operating for military purposes and specialized motor vehicles with special fire safety requirements manufactured or converted by national defense facilities for military activities.

*Entities Required to Obtain Fire Prevention and Fighting Permits

  1. Headquarters of state agencies at all levels, working offices of specialized agencies, enterprises, organizations with more than 5 floors or a volume exceeding 5,000m3.
  2. Apartment buildings, multi-purpose buildings, collective houses, dormitories.
  3. Schools:
  • Vocational schools, intermediate schools, colleges, universities.
  • Preschools, primary schools, secondary schools, high schools.
  • Other educational centers established under the Education Law.
  1. Markets, commercial centers, electronics stores, grocery stores, convenience stores, eateries, restaurants.
  2. Hotels, resorts, guesthouses, motels, accommodation establishments established under the Tourism Law.
  3. Theaters, circuses, cinemas, conference centers, event venues, cultural centers, karaoke bars, dance clubs, beauty salons, massage parlors, entertainment facilities.
  4. Hospitals:
  • Medical examination and treatment facilities.
  • Nursing homes, rehabilitation centers, cosmetic surgery centers, nursing homes with more than 21 beds.
  • Disease prevention and control facilities.
  • Medical centers, healthcare facilities.
  1. Museums, libraries, exhibition halls, showrooms, bookstores, archives, fairs, religious establishments.
  2. Post offices, radio and television broadcasting facilities, telecommunications facilities, data storage and management centers, information equipment installation facilities.
  3. Airports, seaports, inland waterway ports from level IV, district-level bus stations, railway stations with a floor area exceeding 500m2.
  4. Sports facilities established under the Physical Education and Sports Law:
  • Stadiums.

  • Sports and fitness centers.
  • Racetracks, shooting ranges.

  • Urban development, residential area, industrial zone, high-tech zone, export processing zone planning projects.
  • Renovation or new construction projects for technical infrastructure related to fire prevention and firefighting in urban areas, residential areas, industrial zones, high-tech zones, export processing zones.
  1. Warehouses for materials, weapons, support tools, construction projects for import, export, processing, or transportation of petroleum, gas, industrial explosives.
  2. Gas stations with more than one pump, gas stores with a total gas storage exceeding 70kg.
  3. Warehouses for flammable goods with a volume exceeding 1,000m3.
  4. Residential houses combined with production or trading of flammable or explosive goods, goods in flammable packaging by households.
  5. Who is Eligible for a Fire Prevention and Fighting Design Approval Certificate? According to Clause 3, Article 13 of Decree 136/2020/ND-CP, entities eligible for fire prevention and fighting certificates include:
  • Urban planning projects or adjustments to urban planning, economic zones, industrial zones, industrial clusters, export processing zones, high-tech zones, and other functional zones under the 2017 Planning Law.
  • Projects and constructions specified in Appendix V issued with Decree 136/2020/ND-CP when newly built, renovated, or repurposed, affecting one of the fire safety requirements specified in point b, clause 5, Article 13 of Decree 136/2020/ND-CP.
  • Motor vehicles with special fire safety requirements specified in item 21 of Appendix V issued with Decree 136/2020/ND-CP when newly manufactured or converted, affecting one of the fire safety requirements specified in point c, clause 5, Article 13 of Decree 136/2020/ND-CP.
  1. Regulations on Administrative Sanctions for Non-Compliance with Fire Prevention and Fighting Regulations?

According to Article 38 of Decree 144/2021/ND-CP on sanctioning administrative violations in security, order, social safety, prevention and control of social evils, fire prevention and fighting, rescue and rescue, and prevention and control of domestic violence:

Article 38. Violations against regulations on fire prevention and firefighting in investment and construction

  1. A fine ranging from 1.000.000 VND to 3.000.000 VND shall be imposed for failure to have measures and instruments for assurance of fire safety during the construction process as prescribed by law.
  2. A fine ranging from 8.000.000 VND to 15.000.000 VND shall be imposed for any of the following violations:
  3. a) Executing construction against the fire safety designed approved by a competent authority;
  4. b) Modifying, repurposing a work or motor vehicle before having the fire safety design certificate or approval document;
  5. c) Falsifying the certificate of approval or the document approving the commissioning result or other documents relevant to fire prevention and firefighting commissioning issued by competent authorities.
  6. A fine ranging from 15.000.000 VND to 25.000.000 VND shall be imposed for any of the following violations:
  7. a) Executing construction of a work subject to fire safety appraisal before having the fire safety design certificate or approval document;
  8. b) Manufacturing motor vehicles subject to fire safety appraisal before having the fire safety design certificate or approval document.
  9. A fine ranging from 30.000.000 VND to 50.000.000 VND shall be imposed for putting into operation a work, work item or motor vehicle before having the fire safety commissioning document.
  10. A fine ranging from 40.000.000 VND to 50.000.000 VND shall be imposed for putting into operation a work, work item or motor vehicle before having the fire safety design certificate or approval document.
  11. Remedial measures:
  12. a) Mandatory fire safety appraisal in case of violations specified in Point b Clause 2 and Clause 3 of this Article;
  13. b) Mandatory fire safety commissioning in case of violations specified in Clause 4 of this Article;
  14. c) Mandatory fire safety appraisal and commissioning in case of violations specified in Clause 5 of this Article;
  15. d) Mandatory return of the certificate of fire safety approval or commissioning in case of violations specified in Point c Clause 2 of this Article.

In addition, there will be fire safety inspections, either regular, periodic, or unannounced.
