SERVICE FOR TEMPORARY RESIDENCE CARDS FOR FOREIGNERS

I. SERVICE PROVISION PROCESS AT VINASC:

 

Step 1: VinaSC receives information regarding the issuance of temporary residence cards from customers with the following basic details:

  • Review the personal information of the customer applying for temporary residence: Passport, temporary residence confirmation from the local police station.
  • Verify the passport’s validity (according to regulations, the applicant’s passport must be valid for at least 1 year).
  • Documents proving eligibility for a temporary residence card for foreigners, valid for at least 1 year: Work permit, confirmation of being the Head of Representative Office, or member of the Board of Directors.

Step 2: Depending on each specific case, VinaSC will review, advise, and guide the procedures for obtaining a temporary residence card for foreigners. Both parties discuss to finalize the service details. VinaSC then drafts the necessary documents based on the provided materials for the enterprise to authenticate.

Step 3: VinaSC guides the customer in preparing the related documents for the temporary residence card application, such as:

  • Notarized copy of a passport valid for at least 6 months.
  • 02 photos sized 2×3 cm (one attached to the application form, one separate).
  • Temporary residence confirmation from the local police.

Step 4: VinaSC prepares the following documents and hands them over to the customer for signature./h4>

Step 5: Receive the signed documents from the customer and verify their authenticity.

Step 6: Submit the documents to the Immigration Management Department of the provincial police where the inviting/guaranteeing organization is located or where the inviting/guaranteeing individual resides.

Step 7: Deliver the final results to the customer.

IV. REGULATIONS ON CASES ELIGIBLE FOR TEMPORARY RESIDENCE CARDS, TEMPORARY RESIDENCE CARD CODES ACCORDING TO VIETNAMESE LAW

Conditions for applying for a temporary residence card:

  • Foreigners entering for activities consistent with Vietnamese law, not subject to entry prohibition or temporary exit suspension as per Article 21, Article 28, and eligible cases for temporary residence cards under Article 36 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam.
  • Foreigners who are members of diplomatic missions, consular offices, representative offices of international organizations under the United Nations, intergovernmental organizations in Vietnam, and their spouses, children under 18 years old, and accompanying domestic workers during their term.
  • Foreigners entering with visas marked LV1, LV2, LS, ĐT1, ĐT2, ĐT3, NN1, NN2, DH, PV1, LĐ1, LĐ2, TT.

Temporary residence card validity

According to Circular 31/2015/TT-BCA, the validity of the temporary residence card is issued in accordance with the purpose of entry and the request of the agency, organization, or individual. The card has a validity from 1 to 5 years but is at least 30 days shorter than the passport’s validity.

Penalties for non-compliance with temporary residence regulations?

According to Article 18 of Decree 144/2021/ND-CP on administrative penalties in the fields of security, order, social safety; prevention and control of social evils; fire prevention and fighting; rescue and salvage; and domestic violence prevention, foreigners will face the following penalties for non-compliance with temporary residence regulations:

Article 18. Violations against regulations on exit, entry, transit, residence and travel

  1. A fine of from VND 500.000 to VND 2.000.000 shall be imposed for any of the following violations:

  1. dd) A foreigner still uses certificate of temporary residence, approval of temporary residence extension or temporary resident card or fails to apply for replacement of permanent residence card for residing in Vietnam without obtaining permission from a competent authority when one of these documents has been expired for less than 16 days.
  1. A fine of from VND 3.000.000 to VND 5.000.000 shall be imposed for any of the following violations:

  1. e) A foreigner still uses certificate of temporary residence, approval of temporary residence extension or temporary resident card or fails to apply for replacement of permanent residence card for residing in Vietnam without obtaining permission from a competent authority when one of these documents has been expired for from 16 days to less than 30 days;
  1. A fine of from VND 5.000.000 to VND 10.000.000 shall be imposed for any of the following violations:

  1. b) A foreigner still uses certificate of temporary residence, approval of temporary residence extension or temporary resident card or fails to apply for replacement of permanent residence card for residing in Vietnam without obtaining permission from a competent authority when one of these documents has been expired for from 30 days to less than 60 days.
  1. A fine of from VND 10.000.000 to VND 15.000.000 shall be imposed for any of the following violations:

  1. b) A foreigner still uses certificate of temporary residence, approval of temporary residence extension or temporary resident card or fails to apply for replacement of permanent residence card without obtaining permission from a competent authority when one of these documents has been expired for from 60 days to less than 90 days;
  1. A fine of from VND 15.000.000 to VND 20.000.000 shall be imposed for any of the following violations:

  1. b) A foreigner fails to use his/her visa, temporary resident card or approval of temporary residence extension for the stated purpose or program;
  2. d) A foreigner still uses certificate of temporary residence, approval of temporary residence extension or temporary resident card or fails to apply for replacement of permanent residence card without obtaining permission from a competent authority when one of these documents has been expired for 90 days or more;
  3. dd) An agency or organization that uses or employs foreigners fails to follow procedures for inviting or sponsoring them to apply for issuance of visa or temporary resident card, unless these documents can be repurposed as prescribed by law.

Therefore, violations regarding temporary residence cards will incur administrative penalties, potentially up to 40,000,000 VND, along with other supplementary penalties.
