1. EVFTA
– Appendix 8B: Ground services, excluding aircraft maintenance and cleaning, ground transportation, airport management and flight assurance services: Not committed. 5 years after Vietnam allows a private supplier to access an airport or airport terminal, the foreign service supplier is only allowed to provide services at that airport or airport terminal through a joint venture with Vietnamese enterprises with foreign capital contribution not exceeding 49%. 3 years later, the foreign capital limit was raised up 51%. The list of activities and the number of service providers at each airport depends on the size of the airport. For greater certainty, Vietnam reserves the right to consider licensing the above joint ventures based on the following, among many others: (i) real socio-economic benefits that EU investors can generate, including but not limited to long-term commitments, capacity building and technology transfer to Vietnam, their priority contributions for the Vietnamese economy; (ii) financial capacity and relevant experience; and (iii) possible impact on the national security of Vietnam. Allowing private suppliers access to the above mentioned industry means allowing the participation of at least one 100% privately owned Vietnamese company or a joint venture in which the private equity of Vietnam accounts for at least 51%. – Appendix 8-B: In-flight meal service Foreign service suppliers are only allowed to provide services through the establishment of joint ventures with Vietnamese partners in which the foreign capital contribution cannot exceed 49%. 2. CPTPP Appendix NCM II-VN-7: Services related to air transport: Vietnam reserves the right to maintain or adopt any measure relating to: – Special flight services (except for commercial flight training); – Ground operations; – Airport operation service 3. Law of Vietnam Aviation services at airports and airfields include: a) Passenger terminal operation service; b) Airport operation services; c) Service of operating station, warehouse of goods; d) Aviation fuel supply service; d) Ground commercial technical service ; e) Airline meal delivery service; g) Repair and maintenance services for aviation vehicles and equipment; h) Aviation technical services; i) Aviation security services. Minimum capital to set up and maintain airline service providers At the airport, aerodrome: a) Providing passenger terminal operation service: 30 billion VND; b) Provision of terminal and warehouse operation services: 30 billion VND; c) Providing aviation petroleum services: 30 billion VND For enterprises providing passenger terminal, cargo terminal operation services, aviation petroleum services, ground commercial technical services, airport operation services, the capital contribution ratio of foreign individuals and organizations must not exceed 30% of the charter capital of the enterprise. |
